Terms of Use

Last Updated: 5 January 2025

1. Definitions, Scope, and Legal Interpretation

1.1 Purpose and Scope of These Terms

These Terms and Conditions (“Terms”) establish the legally binding framework governing access to, registration on, and use of the MuyuLink platform, including all related websites, mobile interfaces, applications, software systems, digital wallets, social features, marketplaces, and communication tools (collectively referred to as the “Platform”). The purpose of these Terms is to clearly define the rights, obligations, limitations, and responsibilities of all users, while ensuring transparency, legal compliance, and operational integrity across all services provided by MuyuLink. By defining expectations at the outset, these Terms aim to protect users, the platform, and third parties from misuse, misunderstanding, or legal risk.

These Terms apply to all categories of users, including but not limited to registered account holders, visitors, content creators, buyers, sellers, employers, job seekers, advertisers, promoters, and any individual or entity interacting with the Platform in any capacity. Whether a user accesses the Platform occasionally or engages in frequent financial or social activity, these Terms govern every interaction without exception. Continued use of the Platform constitutes ongoing acceptance of these Terms, including any future updates or modifications.

1.2 Definitions of Key Terms

For the purpose of clarity and consistency, specific terms used throughout this Agreement carry defined meanings. “MuyuLink,” “we,” “our,” or “us” refers to the platform operator, including its affiliates, partners, contractors, and authorized service providers. “User,” “you,” or “your” refers to any individual or entity accessing or using the Platform, whether registered or not. “Account” means a registered user profile created to access Platform services, while “Wallet” refers to the digital balance system provided for internal transactions.

The term “Peer-to-Peer (P2P)” describes direct interactions or value exchanges between users without MuyuLink acting as a financial intermediary or guarantor. “Content” includes all text, audio, video, images, listings, messages, posts, and other materials uploaded or generated by users. These definitions apply equally across singular and plural usage and are intended to eliminate ambiguity in interpretation. Where a term is not explicitly defined, it shall be interpreted according to its ordinary meaning within the context of digital platforms and financial technology services.

1.3 Interpretation and Legal Construction

Headings and numbering used throughout these Terms are provided solely for organizational convenience and do not affect the legal meaning or interpretation of any provision. Words such as “including,” “such as,” or “for example” are illustrative and do not limit the scope of the relevant clause. References to laws or regulations include any amendments, replacements, or successor legislation applicable at the time of interpretation.

If any provision of these Terms is found to be unlawful, invalid, or unenforceable by a court of competent jurisdiction, such provision shall be severed without affecting the validity or enforceability of the remaining sections. The remaining provisions shall continue in full force and effect, ensuring that the overall intent and structure of the Agreement are preserved. These Terms represent the entire agreement between you and MuyuLink concerning use of the Platform and supersede any prior agreements, representations, or understandings.

2. Eligibility, Age Requirements, and Legal Capacity

2.1 Minimum Age Requirement

Access to and use of the MuyuLink Platform is strictly limited to individuals who are eighteen (18) years of age or older. This age requirement applies universally, regardless of jurisdiction, and is implemented to ensure compliance with financial regulations, contractual capacity laws, and data protection standards. By registering for an account or using any feature of the Platform, you expressly represent and warrant that you meet this minimum age requirement.

MuyuLink does not knowingly permit minors to access its services. Accounts found to be associated with individuals under the age of 18 may be immediately suspended or terminated without prior notice. In such cases, any associated wallet balances may be frozen pending verification and lawful resolution. Parents or guardians who believe a minor has accessed the Platform are encouraged to contact MuyuLink immediately to facilitate corrective action.

2.2 Legal Capacity and Authority

In addition to meeting the minimum age requirement, users must possess the legal capacity to enter into binding agreements under the laws of their country of residence. By accepting these Terms, you confirm that you are not restricted or prohibited from entering into contracts due to legal incapacity, guardianship, or other legal limitations. Users who lack such capacity are not permitted to use the Platform under any circumstances.

If you are accessing or using MuyuLink on behalf of a business, organization, or other legal entity, you represent and warrant that you have full authority to bind that entity to these Terms. In such cases, references to “you” or “User” shall apply jointly to both the individual and the represented entity. Any breach of these Terms by the entity shall be deemed a breach by the authorized representative.

2.3 Geographic and Regulatory Limitations

MuyuLink operates as a global platform but does not guarantee that all services are available or lawful in every jurisdiction. Certain features may be restricted, limited, or unavailable based on local laws, regulatory requirements, or risk considerations. Users are solely responsible for determining whether their use of the Platform complies with applicable local, national, or international laws.

Accessing the Platform from a jurisdiction where its use is prohibited or restricted is done entirely at the user’s own risk. MuyuLink disclaims all liability arising from a user’s failure to comply with applicable legal or regulatory obligations. Where required by law, MuyuLink reserves the right to restrict access, block accounts, or suspend services in specific regions without prior notice.

3. Account Registration and User Responsibilities

3.1 Account Creation Process

To access core functionalities of the MuyuLink Platform, including wallet services, content posting, marketplace participation, or peer-to-peer interactions, users must create a registered account. Account registration requires the submission of accurate, current, and complete personal information, including a real name, valid email address, and active phone number. This information forms the basis for identity verification, security monitoring, and regulatory compliance.

Users agree that account credentials are personal and non-transferable. Creating accounts on behalf of others, using false identities, or impersonating another individual or entity is strictly prohibited. MuyuLink reserves the right to refuse account registration or revoke access at its sole discretion where submitted information is deemed inaccurate, misleading, or suspicious.

3.2 Accuracy and Ongoing Maintenance of Information

Users are responsible for ensuring that all information associated with their account remains accurate and up to date at all times. Changes to personal details, contact information, or legal status must be promptly updated within the account settings. Failure to maintain accurate information may impair access to services, delay transactions, or result in account suspension.

MuyuLink relies on user-provided information to meet regulatory obligations, prevent fraud, and facilitate secure interactions. Providing false or outdated information undermines platform integrity and may expose users and third parties to risk. As such, MuyuLink reserves the right to request confirmation or documentation at any time to verify the accuracy of account details.

3.3 Single Account Policy

Each user is permitted to maintain only one active account on the Platform unless expressly authorized in writing by MuyuLink. Multiple accounts created to manipulate platform systems, evade restrictions, abuse promotions, or engage in fraudulent activity are strictly prohibited. Detection of duplicate or linked accounts may result in immediate suspension or termination without refund or compensation.

MuyuLink employs technical, behavioral, and analytical measures to detect violations of the single-account policy. Users found to be circumventing controls through proxies, false identities, or coordinated behavior may face permanent bans. This policy is essential to maintaining trust, fairness, and safety within the MuyuLink ecosystem.

4. Identity Verification, KYC, and Regulatory Compliance

4.1 Purpose of Verification

To comply with global anti-money laundering (AML), counter-terrorism financing (CTF), and fraud prevention regulations, MuyuLink requires certain users to undergo identity verification procedures, commonly referred to as Know Your Customer (KYC). These measures are designed to protect users, prevent criminal misuse of the Platform, and ensure compliance with applicable financial and regulatory standards.

Verification requirements may vary depending on user activity, transaction volumes, geographic location, or risk profile. Some features may remain inaccessible until verification is completed. By using the Platform, users acknowledge and consent to such verification processes as a condition of continued access.

4.2 Required Documentation and Methods

Verification may require the submission of government-issued identification, proof of address, selfies, biometric data, or additional supporting documents. MuyuLink may utilize third-party verification providers to process this information securely and in accordance with applicable data protection laws. Users agree to provide truthful and unaltered documentation when requested.

Failure to complete verification, submission of falsified documents, or attempts to bypass verification controls may result in restricted access, wallet freezes, or account termination. MuyuLink is not obligated to provide alternative verification methods if a user fails to meet standard requirements.

4.3 Ongoing Monitoring and Reverification

Verification is not a one-time process. MuyuLink reserves the right to conduct ongoing monitoring and request re-verification at any time, particularly where changes in user behavior, transaction patterns, or regulatory requirements are identified. Users agree to cooperate fully with such requests to maintain uninterrupted access.

Accounts that fail to meet ongoing compliance standards may be temporarily limited or permanently closed. In cases involving suspected fraud or illegal activity, MuyuLink may retain records and report relevant information to competent authorities as required by law.

5. Account Security, Credentials, and User Liability

5.1 Responsibility for Account Security

Users are solely responsible for safeguarding their account credentials, including usernames, passwords, verification codes, and any linked authentication methods. You agree not to share your login details with any third party and to take reasonable precautions to prevent unauthorized access to your account.

MuyuLink shall not be liable for losses, damages, or unauthorized transactions resulting from compromised credentials where the user has failed to exercise reasonable care. Any activity conducted through your account is presumed to be authorized by you unless proven otherwise through formal investigation.

5.2 Reporting Unauthorized Access

Users must immediately notify MuyuLink upon discovering or suspecting unauthorized access, suspicious activity, or security breaches involving their account. Prompt reporting enables timely mitigation and reduces potential harm. Delays in reporting may limit MuyuLink’s ability to assist and may increase user liability.

MuyuLink may temporarily restrict account access while investigating reported incidents. Users agree to cooperate fully with any security review, including providing additional information or verification if requested.

5.3 Platform Security Measures

While users bear primary responsibility for account security, MuyuLink employs industry-standard security measures, including encryption, fraud detection systems, access controls, and monitoring tools. These measures are designed to protect user data and platform integrity but do not guarantee absolute security.

Users acknowledge that no digital system is entirely immune to risk and agree that MuyuLink is not responsible for security breaches beyond its reasonable control. By using the Platform, users accept these inherent risks and agree to exercise vigilance in protecting their accounts.

6. Wallet Services, Financial Use, and Transaction Rules

6.1 Nature and Purpose of the MuyuLink Wallet

The MuyuLink Wallet is a digital value storage and transfer tool designed exclusively for use within the Platform. It enables users to send, receive, and exchange funds with other users, pay for platform services, and participate in peer-to-peer assistance and marketplace activities. The Wallet does not function as a bank account, savings instrument, investment product, or interest-bearing facility, and no fiduciary relationship is created between the user and MuyuLink.

Funds held in the Wallet represent a prepaid balance usable only as permitted by Platform features and applicable laws. Users acknowledge that Wallet balances are not protected by deposit insurance schemes and may not be recoverable in cases of regulatory intervention, force majeure, or confirmed misuse. MuyuLink retains operational control over the Wallet system to ensure compliance, security, and platform integrity.

6.2 Wallet Funding and Usage Restrictions

Users may fund their Wallets using approved payment methods only, including mobile money, bank transfers, card payments, or other authorized channels. All funds deposited must originate from legitimate, lawful sources. The use of stolen funds, unauthorized payment instruments, or third-party accounts without permission is strictly prohibited and constitutes a serious violation of these Terms.

MuyuLink reserves the right to impose limits on Wallet balances, transaction volumes, or frequency based on verification level, regulatory requirements, or risk assessment. Users agree that Wallet transactions are final once confirmed, except where expressly stated otherwise by Platform policy. Any attempt to reverse, dispute, or manipulate confirmed Wallet transactions outside permitted channels may result in account suspension or legal action.

6.3 Freezing, Holding, and Blocking of Wallet Funds

To comply with AML, fraud prevention, and legal obligations, MuyuLink may temporarily or permanently freeze Wallet balances under certain circumstances. These include suspected fraud, chargebacks, disputes, regulatory requests, court orders, or violations of Platform rules. Such actions may be taken without prior notice where immediate risk is identified.

Frozen funds will remain inaccessible until investigations are completed. Users acknowledge that MuyuLink is not liable for losses arising from lawful freezes or compliance actions. Where legally permitted, MuyuLink may confiscate funds associated with confirmed fraud, abuse, or criminal activity and cooperate with relevant authorities.

7. Peer-to-Peer (P2P) Exchanges and Community Assistance

7.1 Nature of P2P Interactions

MuyuLink facilitates direct peer-to-peer interactions between users, including cash assistance, currency exchange, airtime support, bill payments, and informal help requests. These interactions are user-driven and based on mutual agreement. MuyuLink does not act as a broker, guarantor, escrow agent, or insurer for P2P exchanges.

Users understand that P2P transactions involve personal judgment and trust. Any decision to meet, exchange cash, or provide assistance is made at the user’s own discretion and risk. MuyuLink provides tools to identify verified users but does not guarantee behavior, outcomes, or fulfillment.

7.2 Confirmation and Finality of P2P Transactions

Once a user confirms a Wallet transfer to another user in a P2P context, the transaction is deemed final and irreversible. Users are strongly advised to verify recipient identity, agreement terms, and conditions before confirming any transfer. Mistaken transfers, change of mind, or disputes after confirmation do not entitle users to automatic reversal.

MuyuLink may offer dispute-reporting tools; however, such tools do not guarantee recovery of funds. Decisions made during dispute resolution are based on platform records, timestamps, communication logs, and compliance standards, and are final.

7.3 Safety, Meetups, and User Responsibility

Physical meetups arranged through the Platform occur entirely at the users’ own risk. MuyuLink does not supervise, monitor, or participate in in-person exchanges. Users are encouraged to meet in public places, avoid carrying large sums of cash, and prioritize personal safety.

MuyuLink disclaims all liability for theft, injury, intimidation, or loss arising from user-arranged meetings. Users accept full responsibility for their actions and agree not to hold MuyuLink liable for outcomes resulting from offline interactions.

8. Marketplace Listings, Buying, and Selling

8.1 Marketplace Role and Limitations

The MuyuLink Marketplace enables users to list, discover, and transact goods and services directly with one another. MuyuLink acts solely as a technology provider and does not own, inspect, store, or deliver listed items. All marketplace transactions occur directly between buyers and sellers.

Users acknowledge that MuyuLink does not guarantee product quality, authenticity, delivery timelines, or seller reliability. Participation in marketplace transactions is voluntary and undertaken at the user’s own risk.

8.2 Seller Responsibilities

Sellers must ensure that listings are accurate, lawful, and non-misleading. This includes truthful descriptions, clear pricing, and disclosure of relevant conditions. Selling illegal, prohibited, counterfeit, or restricted items is strictly forbidden and may result in immediate account termination.

Sellers are responsible for fulfilling orders, handling delivery, managing customer communication, and resolving issues directly with buyers. Failure to meet obligations may lead to reputation penalties, listing removal, or suspension.

8.3 Buyer Responsibilities and Disputes

Buyers are responsible for reviewing listings carefully before committing to a purchase. Payments made through the Platform do not guarantee delivery or satisfaction. Disputes must be addressed directly with sellers unless fraud or policy violations are evident.

MuyuLink may intervene only in limited cases involving verified fraud, repeated complaints, or serious misconduct. Any intervention is discretionary and does not create liability or guarantee outcomes.

9. Job Listings, Gigs, and Employment Interactions

9.1 Nature of Job-Related Services

MuyuLink allows users to post job opportunities, freelance gigs, and skill-based requests. The Platform does not act as an employer, recruiter, staffing agency, or guarantor of employment outcomes. All employment relationships are strictly between users.

MuyuLink does not verify employer legitimacy, job conditions, salaries, visas, or legal compliance. Users are responsible for conducting due diligence before accepting or offering employment.

9.2 Employment Risks and User Due Diligence

Users acknowledge that job listings may carry inherent risks, including scams, misrepresentation, or unmet expectations. MuyuLink strongly encourages verification, written agreements, and lawful compliance before engaging in employment arrangements.

The Platform disclaims liability for losses, disputes, or harm arising from employment interactions. Reporting tools are provided to flag suspicious listings, but MuyuLink does not guarantee preventative enforcement.

10. Content Posting, Ownership, and Platform License

10.1 User Content Ownership

Users retain ownership of all content they create and upload to the Platform. This includes text, images, videos, audio, and other materials. Ownership does not transfer to MuyuLink by virtue of posting.

However, by submitting content, users grant MuyuLink a non-exclusive, worldwide, royalty-free, transferable license to host, display, distribute, promote, and use such content within Platform operations and marketing.

10.2 Content Standards and Removal

Users may not post content that is illegal, abusive, misleading, defamatory, explicit, or harmful. MuyuLink reserves the right to remove content that violates Platform rules or applicable laws, with or without notice.

Repeated violations may result in account restrictions or termination. MuyuLink is not obligated to store or restore removed content.

11. Monitoring, Enforcement, and Platform Integrity

11.1 Monitoring Activities

MuyuLink actively monitors user activity to detect fraud, abuse, manipulation, and violations of these Terms. Monitoring may include automated systems, manual reviews, and third-party tools.

Users consent to such monitoring as a condition of using the Platform. Monitoring is conducted in accordance with privacy laws and internal policies.

11.2 Enforcement Actions

MuyuLink may take enforcement actions, including warnings, feature restrictions, wallet freezes, content removal, or account termination. Enforcement decisions are made at MuyuLink’s sole discretion and may be irreversible.

Users waive the right to challenge enforcement actions except where required by law.

12. Limitation of Liability and Disclaimers

12.1 No Warranty

The Platform is provided “as is” and “as available.” MuyuLink makes no warranties regarding availability, reliability, accuracy, or suitability for any purpose.

Users assume all risks associated with Platform use.

12.2 Liability Limitations

MuyuLink shall not be liable for indirect, incidental, or consequential damages, including lost profits, missed opportunities, or reputational harm. Total liability, where permitted by law, shall not exceed fees paid to MuyuLink in the preceding three months.

13. Indemnification and Legal Protection

Users agree to indemnify and hold harmless MuyuLink from claims, damages, legal fees, and liabilities arising from their actions, content, violations, or misuse of the Platform.

This obligation survives account termination.

14. Governing Law, Amendments, and Contact

14.1 Governing Law

These Terms are governed by applicable international commercial principles and relevant regional laws where MuyuLink operates, without regard to conflict-of-law rules.

14.2 Amendments

MuyuLink may update these Terms at any time. Continued use constitutes acceptance of updated Terms.
